# Terms of Service

## 1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you and
Nathan Allen, the developer of StarRank ("StarRank," "we," "us," "our"). By
downloading, accessing, or using the App, you agree to be bound by these
Terms and by our [Privacy Policy](/privacy), which is incorporated by
reference. If you do not agree, do not use the App.
## 2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in
your jurisdiction) to use StarRank. By using the App, you represent that you
meet this requirement.
## 3. Your Account
You are responsible for maintaining the confidentiality of your account
credentials and for all activity under your account. Notify us immediately
of any unauthorized use. You agree to provide accurate information when
creating your account.
## 4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms
- Impersonate any person or entity, or misrepresent your affiliation with
any person or entity
- Attempt to gain unauthorized access to the App, other accounts, or our
systems
- Interfere with or disrupt the App's operation or servers
- Use automated means — bots, scrapers — to access the App without our
prior written consent
- Upload, post, or transmit any content that is unlawful, harassing,
defamatory, or infringing
We reserve the right to suspend or terminate accounts that violate these
Terms.
## 5. User Content
Ratings, reviews, and other content you submit through the App ("User
Content") remain yours. By submitting User Content, you grant StarRank a
worldwide, non-exclusive, royalty-free license to host, store, reproduce,
and display that content solely for the purpose of operating and improving
the App. You are solely responsible for your User Content and represent
that you have the right to submit it.
## 6. Third-Party & Catalog Content
Movie, actor, and performance information displayed in the App, including
images sourced from The Movie Database (TMDB), is provided for
informational purposes. StarRank does not guarantee the accuracy,
completeness, or timeliness of this catalog content. This product uses the
TMDB API but is not endorsed or certified by TMDB.
## 7. Intellectual Property
The App, including its design, text, graphics, logos, and underlying
software — but excluding User Content and third-party catalog content — is
owned by Nathan Allen and is protected by copyright, trademark, and other
intellectual property laws. You may not copy, modify, distribute, sell, or
lease any part of the App without our prior written consent.
## 8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY
KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE,
OR THAT ANY RATINGS, REVIEWS, OR CATALOG INFORMATION ARE ACCURATE OR
RELIABLE. YOU USE THE APP AT YOUR OWN RISK.
## 9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL
STARRANK, ITS OWNER(S), OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE
DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR
RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF WE HAVE BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR
RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE
AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR
(B) FIFTY U.S. DOLLARS ($50).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN
DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
## 10. Indemnification
You agree to defend, indemnify, and hold harmless StarRank, its owner(s),
officers, and personnel from and against any claims, liabilities, damages,
losses, and expenses (including reasonable attorneys' fees) arising out of
or in any way connected with: (a) your use of the App; (b) your User
Content; (c) your violation of these Terms; or (d) your violation of any
rights of a third party.
## 11. Termination
We may suspend or terminate your access to the App at any time, with or
without cause or notice, including for violation of these Terms. You may
stop using the App and delete your account at any time from Settings.
Sections 5–10 and 12–15 survive termination.
## 12. Changes to the App and These Terms
We may modify or discontinue the App, in whole or in part, at any time. We
may update these Terms from time to time; material changes will be
reflected by an updated "Effective Date" above. Your continued use of the
App after changes take effect constitutes your acceptance.
## 13. Apple App Store Terms
If you downloaded the App from Apple's App Store, you acknowledge that
these Terms are between you and StarRank only, not Apple, and Apple has no
responsibility for the App or its content. Apple has no obligation to
furnish any maintenance or support for the App. In the event of any failure
of the App to conform to any applicable warranty, you may notify Apple, and
Apple will refund the purchase price, if any; to the maximum extent
permitted by law, Apple has no other warranty obligation with respect to
the App. Apple is not responsible for addressing any claims relating to the
App, including product liability claims, legal compliance claims, or claims
under consumer protection laws. Apple is a third-party beneficiary of these
Terms and, upon your acceptance, will have the right to enforce them
against you.
## 14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard
to conflict-of-law principles.
